The European Commission and the National Center for the Protection of Older People in Ireland collaborated to produce a background paper looking at elder abuse in Europe from 1975 and on. The paper, Elder Abuse in Europe, serves as a guide to better understand and tackle elder abuse both on a national and an international level.
IAHSA is interested in learning about programs that help prevent elder abuse and/or provide services to elderly who are victims of abuse. Please send information on such programs to iahsa@aahsa.org.

Who Guard the Guardians – New Development (TAS. AUSTRALIA)
I posted a short article regarding Elder Abuse by Guardianship Board, or the court appointed ‘Trustees’, on December 15, 2009.

I was informed of at least 2 cases in Tasmania, Australia. However, an anonymous email, has alerted me to more cases in Tasmania. This is more serious than we originally thought. Apparently, there was a ’email blitz’ to politicians in that state; alerting them to this very issue.
If you know of more cases of Elder Abuse by Guardianship Board or court appointed ‘trustees’ please contact me and supply me with details that I could use to help highlight this issue.

Here is a brief outline of what actually has happened to Maria and maybe this will explain a bit more for you to understand the whole situation.
MARIA BXXXXXXX of 1X Cxxxxxxx Street Txxxxxxxx Tasmania 7250 Australia Immigrated to Australia in 1960 from Poland to be married.
All Maria’s medical report and other can be supply on request.
Maria Bxxxxxxxx was abused by having a limited access to adequate food By Mrs Sxxxxxx she was given access to meals on wheels 3 times a week, the rest of the time she had to fend for herself and she was not given money nor was shopping done for her.
FINANCIAL ABUSE – By Mrs Sxxxxxx with financial loss from the sale of her property which Mrs Sxxxxx stated that Maria had gifted her the money from the Sale of the house and Unit, and that Maria had attended Centerlink with her in regard to this matter. Yet the officer at Centerlink who dealt with Mrs Sxxxxxxx stated that Maria was never present as Mrs Sxxxxxx had stated..
Financial loss of property which was removed from Maria’s house and personal items, Sale of Coastal Property
PHYSICAL ABUSE – By Mrs Sxxxxxx who gave Maria tablets and over medicated her especially when they went to appointments like the DR or Lawyer Mrs Sxxxxxx would make Maria take a tablet which made Maria feel like she was incoherent and did not know what was going on around her.
PSYCHOLOGICAL ABUSE
Maria was in fear as Mrs Sxxxxxx would make threats towards Maria in regard to TAX Fraud and Jail and in authoritative persons like the Police which Maria fears as Stated in a letters by Mrs Sxxxxxx.
In the above matters – Maria Bxxxxxxxx felt ashamed to admit that a person she trusted with a POA mistreated her.
She was frightened of what might happen to her if she told anyone about her situation especially being frightened of Authoritative figures.
With English being her second language and cultural barriers this restricted Maria in knowledge about services available to her or how she could access them.
Some of the above matters where investigated by THE TASMANIAN POLICE DEPARTMENT which found Mrs Sxxxxxxx guilty on 15 charges in the Magistrates Court but due to her abuser hiding behind the GXXXXXXXXXXX BOARD and giving them her POA ( that been Revoked on 03 February 2006, and Mrs Sxxxxx signed acknowledgement of receiving copies of the document on 09 February 2006 and these been registered at Title Office on 16 February 2006 ) the Supreme Court hearing for the 15 charges on steeling funds at Commonwealth Bank on 13 December 2006 had been dropped by the State Public Prosecutor. Maria’s request for the reason is ignored since 04 April 2007, and her letters not acknowledged till these days.
This being because the POLICE PROSECUTOR was told by certain people who said they were Maria’s Carers (WHICH WAS PERJURY AND NOT TRUE) that Maria is heavy demented and that the witnesses that the DPP would call on do not speak a word of English so they would not be viable.. (WHICH WAS ALSO A LIE) they are migrants but they do speak English and even if they did not what about INTERPRETERS..?
So on these grounds the DPP did not bother to contact the other witnesses and took it on himself to not proceed with the case without further verification.
As stated Maria’s Dr did believe that Maria had a slight form of dementia but this is not the fact due to the over medication from her abuser Mrs Sxxxxxxx Maria acted as a demented person this making the Dr then treat Maria for a illness she did not have since 2004 with harmful psychotic drugs in overdose that give Mrs Sxxxxxxx the help to persuade everyone of Maria’s declination in memories as she mostly been incoherent.
The GXXXXXXXXXXX BOARD have acted on the Dr’s statement that Maria is demented and even tho Maria had made a appointment for a second opinion the Dr and the Gxxxxxxxxxxx Board had cancelled the second opinion and did not allow Maria to seek a independent medical opinion.
They did not even want to hear about the POLICE INVESTIGATION or Maria’s circumstances basically her side of the story to clear the matter up..
They have enforced a Financial Administrator on Maria and on numerous occasions have wanted her placed into respite or a Nursing home which is not necessary.
Maria has since been assessed by other Dr’s who find her competent since her medication which was changed and the over medication has been ceased. Yet to the GXXXXXXXXXXX BOARD this is not relevant to them and they do not take this into consideration and stick to the original findings.
While in Administration Maria’s HUMAN RIGHT was violated once again just like Mrs Sxxxxxxxx had violated it previously Maria’s Right for INDEPENDENCE WAS VIOLATED she was denied her money (AGE PENSION) which had been taken from her for 4 months by the administrator She had no access to purchase adequate food, clothing or health care through the provision of her income . If it was not for the help of good friends to support Maria in this tough time she would of been helpless.
The abuser Mrs Sxxxxxx through all this wrote numerous letters of LIES to the Administrator and the Gxxxxxxxxxxx Board and in these letters Mrs Sxxxxxxx made suggestions which the Administrator and the Gxxxxxxxxxxx Board took on board and followed through with.
Mrs Sxxxxxx was found guilty in the Magistrates Court yet she still contributed to the suggestions of Maria’s welfare which I find is a conflict of interest. In her letters she persuades people that Maria is heavily demented with scenarios of events. Which are very convincing.
Maria never had the same opportunity for her side of the story to be heard and to show her evidence or proof as she has been labelled demented and this matter still stands unresolved to this day, as no one in authority wants to listen or investigate due to the GXXXXXXXXXXXX BOARD being involved now.
This whole case shows that we have a hole in the system where abusers can hide behind Government Bodies, and get away with Elderly Abuse..
On 13 June 2009 Pxxxxx Txxxxxx requested from Gxxxxxxxxxxxx Administration Board to extend their appointment to act as a Financial Administrator for Maria even she strongly objected and have Legal Aide lawyer to represent her, still to these days she do not receive the last order from GXX of 18 September 2009.
It is UNACCEPTABLE for Legal Aid not giving Maria the assistance and files required to appeal to GXX. When we inquired with the Director of Legal Aide in Hobart, the lady lawyer in question took the easy way out and resign, and Maria is lay of again.
